TERMS OF SALES

Article 1 : Seller's designation

These General Terms and Conditions of Sale (hereinafter referred to as "GTC") are entered into between, on the one hand, Les Laboratoires Multaler (hereinafter referred to as "Yon-Ka"), a SAS with capital of €649,276 registered in the Nanterre Trade and Companies Register under number 552 022 824, having its registered office at 16 avenue de l'Agent Sarre 92700 Colombes, and, on the other hand, any person having made a purchase on the https://uk.yonka.com/ website, hereinafter referred to as "the Customer”.

Article 2 : General terms and conditions

1. Purpose of the GTC

The purpose of these GTC is to define the conditions under which Customers may access the Site and order Yonka Paris products, and to detail the rights and obligations of Yonka Paris and Customers.

2. Application of the GTC

The GTC governs the relationship between Customers and Yonka Paris. Any Customer placing an order undertakes to comply with the present GCS without reservation.

3. Modification of the GTC

These GTC were updated on 18 March 2024. Yonka Paris reserves the right to modify its GTC at any time. In the event of modification, the applicable GTC remain those in force at the time of the order placed by the Customer.

4. Terms and conditions

The nullity of a contractual clause does not entail the nullity of the GTC. The temporary or permanent non-application of one or more clauses of the GTC by the professional seller shall not constitute a waiver of the other clauses of the GTC, which shall continue to have effect.

Article 3 : Price

1. Selling price

The sale prices for each of the products listed in the electronic catalogue are indicated in pounds, inclusive of all taxes, excluding delivery and transport costs, which are mentioned before the order is confirmed and invoiced in addition.

The total amount payable by the consumer is indicated on the order confirmation page.

The selling price of the product is the one from the day the order is placed.

The sale price of the products does not include delivery charges, which are invoiced in addition to the price.

2. Modifications to selling prices

Yonka Paris reserves the right to modify its prices at any time, while guaranteeing the consumer the application of the price in force on the day of the order.

3. Costs

The additional costs of transport, delivery or postage (to which must be added any other costs borne by the seller), of which the customer has been made aware before placing the order, are set out on the order form.

Article 4 : Products

1. Presentation of articles

The products offered for sale in the catalogue published on the website are each described in terms of their essential characteristics.

The photographs illustrating the products do not constitute a contractual document.

2. Use of products

Yonka Paris offers cosmetic products for sale, enabling Customers to carry out skincare treatments. These products are only available to private individuals. Yonka Paris undertakes to provide Customers with all the information necessary for the proper use of its cosmetic products. Yon-Ka Paris cannot be held responsible for damage caused by misuse of the products sold on its site or by failure to observe the precautions for use. 

3. Compliance

The products sold by Yon-Ka Paris comply with the requirements of current French law relating to personal health and safety, fair trading and consumer protection at the time they are placed on the market.

4. Availability

Products are offered and delivered while stocks last. In the event of unavailability of the products ordered, Yon-Ka Paris undertakes to inform the Customer immediately and to offer equivalent products or a refund of the price of the unavailable product. Apart from the reimbursement of the price of the unavailable product, Yon-Ka Paris is not liable for any cancellation indemnity, unless it is personally responsible for the non-performance of the contract.

5. Resale of products

The Customer is required not to resell the products ordered on the site without the written agreement of Yon-Ka Paris.

Article 5 : Order

1. Order process

The Customer fills a virtual basket with the products they have selected. They can then check the details of their order. The Customer can then click on the "Place Order" or "Checkout" button and add the information relating to the delivery and payment methods. The Customer will then receive an email confirming receipt of the order by Yon-Ka Paris.

2. Order’s modification

Yon-Ka Paris reserves the right to accept or reject the modification of a Customer's order once it has been confirmed. Yon-Ka Paris reserves the right to modify the product ordered in line with technical developments in accordance with article R. 212-4 of the French Consumer Code.

3. Validating an order

Yon-Ka Paris reserves the right to refuse any order for legitimate reasons and more particularly if the quantities of products ordered are abnormally high for buyers who are consumers. Yon-Ka Paris may also refuse or delay the processing of an order if any fraud is suspected, such as identity theft or theft of means of payment.

Article 6 : Contract

1. Conclusion

The sales contract is formed when the consumer sends confirmation of their order.

Communications, order forms and invoices are archived on a reliable and durable medium so as to constitute a true and durable copy in accordance with article 1360 of the French Civil Code (former C. civ., art. 1348). These communications, order forms and invoices may be produced as proof of the contract.

Article 7 : Payment 

1. Eligibility 

Once the order has been validated, the Customer automatically accepts the General Terms and Conditions of Sale. The price is payable in full once the order has been confirmed. Payment is made immediately upon ordering by credit card.

2. Payment methods

They then pay on the https://uk.yonka.com/ website by credit card (CB, Visa, Mastercard, American Express, Apple Pay, Paypal).

3. Secured payment

The Yonka Paris website is equipped with a secure online payment system enabling the Customer to encrypt the transmission of his/her bank details via the electronic payment server of the secure payment platform. At no time will the consumer's bank details pass through the Yonka Paris computer system.

4. Payment verification

In the event of abusive practices or fraudulent appearances, Yon-Ka Paris reserves the right to carry out checks on orders and to request certain documents and information concerning the Customer in order to validate the order.

Article 8 : Shipping

1. Delivery charges

Delivery costs are explicitly stated on the https://uk.yonka.com/pages/shipping-policy website.

2. Delivery time

The delivery time depends on the delivery method chosen by the Customer, as indicated on the site when the order is placed. The delivery time for an order includes its preparation, dispatch and delivery to the delivery address indicated by the Customer.

Under normal conditions, Yon-Ka Paris will process the order as quickly as possible from Monday to Friday, excluding public holidays. 

3. Place of delivery

Products are delivered to the delivery address indicated by the Customer on the order form.

4. Delayed delivery

In the event of a delay in delivery of more than 5 working days, the Customer must inform Yon-Ka Paris customer service, which will take the necessary and appropriate action.

5. Product compliance

If the product does not conform to the order, the consumer must submit a complaint to the professional vendor with a view to obtaining a replacement product or, where appropriate, cancellation of the sale.

6. Transfer of ownership

From the delivery date indicated on the order form, ownership of the product is transferred to the Customer, except where full payment of the price has not been received at the time the order is placed.

Article 9 : Returns and right of withdrawal

Customers have a right of return of fifteen days from receipt of their order to return any item that does not suit them and request an exchange or refund.

The right of withdrawal may be exercised by contacting Yon-Ka Paris customer service by e-mail (contact@yonka.com).

Returns are to be made in their original condition and complete allowing their remarketing in new condition. Any product opened or damaged by the consumer will not be accepted. Yon-Ka Paris reserves the right to judge whether the product can be remarketed or not, according to its quality standards.

In the event of retraction, Yon-Ka Paris will reimburse all payments received. Either by re-crediting the credit card or Paypal account of the consumer, or by bank transfer depending on the method of payment of the order.

Yon-Ka Paris will only reimburse returned products once they have been received and their intact condition has been checked.

Article 10 : Intellectual property

All visual, sound and textual elements visible on the site are the exclusive property of Yonka-Paris. Any reproduction or representation of the Yon-Ka Paris brand is prohibited.

Article 11 : Personal data

Yon-Ka Paris processes consumer information in accordance with its Privacy Policy.

Article 12 : Disputes and claims

In the event of a dispute, the Customer must contact Yon-Ka Paris customer service by e-mail (contact@yonka.com) in order to attempt to resolve the dispute informally.

Yon-Ka Paris shall not be held liable for any damage resulting from improper use of its products.

Article 13 : Applicable law

The Terms and Conditions of this agreement and all related matters are governed by the domestic laws of France. You hereby irrevocably submit to the exclusive jurisdiction of the courts of France in relation to all disputes arising from or related to this Agreement, your use of a Website and any related matters.
